A. Procedure for Reporting Intellectual Property Infringement

It is NBA Fan Swag’s policy to:

If you believe that content residing on or accessible through the NBA Fan Swag website infringes your copyright or other intellectual property rights, please send a notice of infringement containing the following information to the contact listed in Section D below:

1. Identification of the copyrighted work, trademark, or other intellectual property that you claim has been infringed, including registration number(s), if applicable;
2. Identification of the content that you claim is infringing, including a description of how the material is using the copyrighted work, trademark, or other intellectual property in a way that constitutes infringement;
3. The URL or specific location on the NBA Fan Swag website where the allegedly infringing material appears, with enough detail for us to locate and review it;
4. Your contact information, including your full name, mailing address, telephone number, and email address;
5. A statement that you have a good faith belief that the disputed use is not authorized by the rights holder, its agent, or the law;
6. A statement, made under penalty of perjury, that the information provided in your notice is accurate and that you are the rights holder or are authorized to act on behalf of the rights holder;
7. Your electronic or physical signature, or the electronic or physical signature of the person authorized to act on behalf of the rights holder.

B. Action After Receiving a Proper Notice

After receiving a proper, bona fide infringement notice, NBA Fan Swag may take one or more of the following actions:

1. Remove or disable access to the allegedly infringing content;
2. Review the identified material and related product listing or page;
3. Notify the relevant user, supplier, contributor, or service partner, if applicable;
4. Request additional information from the complaining party or relevant party, if needed;
5. Take action regarding repeat infringers, which may include removing content, refusing service, or terminating access where applicable.

C. Procedure for Submitting a Counter-Notice

If you believe that content was removed or disabled as a result of mistake, misidentification, or because you have the right to use the material, you may send a counter-notice to the contact listed in Section D below.

Your counter-notice must include the following information:

1. Identification of the content that has been removed or disabled, including the URL or location where the material appeared before it was removed or disabled;
2. A statement, made under penalty of perjury, that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification;
3. Your contact information, including your full name, mailing address, telephone number, and email address;
4. A statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located, or, if your address is outside of the United States, the federal judicial district in which NBA Fan Swag or SKINNY WALLET LLC is located;
5. A statement that you will accept service of process from the person who provided the original infringement notice or from that person’s agent;
6. Your electronic or physical signature.

If a valid counter-notice is received, NBA Fan Swag may send a copy of the counter-notice to the original complaining party. Unless the rights holder files an action seeking a court order against the relevant party, the removed content may be restored, or access to it may be re-enabled, within 10 to 14 business days or another period permitted by applicable law, at NBA Fan Swag’s discretion.
